1. Agreement to Terms
By accessing or using ServiceStack's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.
2. Description of Services
ServiceStack provides website design, hosting, AI-powered lead response, and related digital marketing services for home service contractors. Our services include website creation, maintenance, and optimization, as well as automated customer communication tools.
3. Subscriptions and Billing
Our services are provided on a subscription basis. By subscribing, you agree to:
- Pay all fees associated with your chosen plan
- Provide accurate billing information
- Authorize recurring charges until you cancel
Subscriptions automatically renew unless cancelled. You may cancel at any time, and your service will continue until the end of your current billing period.
4. Money-Back Guarantee
We offer a 14-day money-back guarantee for new subscribers. If you're not satisfied within the first 14 days, contact us for a full refund. This guarantee applies only to the first subscription period.
5. Your Responsibilities
You agree to:
- Provide accurate business information for your website
- Respond to requests for content and approvals in a timely manner
- Not use our services for illegal purposes
- Not upload content that infringes on others' rights
- Maintain the confidentiality of your account credentials
6. Intellectual Property
Our Property: ServiceStack retains ownership of all website templates, code, software, and proprietary tools used to create and host your website.
Your Property: You retain ownership of your business content, including your logo, images, text, and any content you provide to us. Upon termination, we will assist in transferring your content to another provider upon request.
7. Website Hosting and Maintenance
Your website is hosted on our infrastructure as part of your subscription. We are responsible for server maintenance, security updates, and uptime. While we strive for 99.9% uptime, we do not guarantee uninterrupted service and are not liable for downtime.
8. AI Services
Our AI lead response services operate automatically but may not always respond perfectly to every situation. You are responsible for monitoring conversations and can intervene at any time. We are not liable for any miscommunications or errors made by the AI system.
9. Content Updates
Unlimited content updates are included in your subscription. We will make reasonable efforts to complete update requests within 24-48 hours. Complex requests may take longer.
10. Limitation of Liability
To the maximum extent permitted by law, ServiceStack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless ServiceStack from any claims, damages, or expenses arising from your use of our services or your violation of these terms.
12. Termination
Either party may terminate the subscription at any time. Upon termination, your website will remain active until the end of your current billing period. We reserve the right to terminate service immediately for violations of these terms.
13. Dispute Resolution
Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Diego, California.
14. Changes to Terms
We may modify these terms at any time. We will notify you of material changes via email or through our service. Continued use of our services after changes constitutes acceptance of the new terms.
15. Governing Law
These terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
